The software and services are provided "as is" without warranty of any kind, either express or implied. While we strive for accuracy and reliability, Duka Track Softwares Ltd makes no representations or warranties regarding the completeness, accuracy, or reliability of any information or services.

3. Limitation of Liability

To the maximum extent permitted by Kenyan law, Duka Track Softwares Ltd, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Our total liability for any claims arising from the use of our services shall not exceed the amount paid by the client for the services in the twelve (12) months preceding the claim.

7. Dispute Resolution

Any disputes arising from these terms or the use of our services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through arbitration in Nairobi, Kenya, in accordance with the Arbitration Act, 1995.

The courts of Nairobi, Kenya shall have exclusive jurisdiction over any legal proceedings.
